Official Rules and Conditions
Eligibility
Diamond Laboratories, Inc. dba Dr. Diamond’s Metacine will be giving away one (1) InstaFacial® and twelve (12) InstaFacial Collections ("Giveaway"). The Giveaway is open only to those legal residents of the fifty United States and the District of Columbia who are at least eighteen (18) years of age or older as of the date of participation and who meet the eligibility requirements. The officers, directors, employees, contractors, and agents of Diamond Laboratories, Inc. or any related or affiliated persons or organizations, and the immediate families and those living in the same household of any of the above, are not eligible. All Federal, state and local rules and regulations apply. Void where prohibited or restricted by law. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Conditions, and the decisions of Diamond Laboratories, Inc., which are final and binding in all matters related to the Giveaway.
Being selected as a recipient of the Giveaway is conditioned on the satisfaction of all qualification requirements and conditions set forth herein.
Giveaway Period
The Giveaway eligibility period starts on December 14, 2023, at 06:00 AM EST and ends on December 31, 2023, at 11:59 PM PST (the "Giveaway Period"). Diamond Laboratories, Inc. shall select recipients of the Giveaway within ten (10) calendar days following the end of the Giveaway Period.
Sponsor
The sponsor of the Giveaway is Diamond Laboratories, Inc., dba Dr. Diamond’s Metacine, 9400 Brighton Way, Penthouse, Beverly Hills, CA 90210 (the "Sponsor").
Agreement to Official Rules and Conditions
The Giveaway shall be subject to these Official Rules and Conditions. All participants agree to be bound by the terms and conditions set forth herein, and acknowledge that receipt of the Giveaway is subject to satisfaction of all of the requirements and conditions set forth herein, and that certain restrictions may apply.
Qualifications to Participate
During the Giveaway Period, Sponsor will publish a series of twelve (12) posts on Sponsor’s @drdiamondsmetacine Instagram grid, once per day, beginning on December 14, 2023, and ending on December 25, 2023.
In order to qualify for the Giveaway, you must to do the following during the Givaway Period:
- visit and follow the @drdiamondsmetacine Instagram page;
- tag 3 friends on any or all of the Sponsor’s twelve (12) Instagram posts; and,
- share any or all of the Sponsor’s twelve (12) Instagram posts and tag @drdiamondsmetacine.
Any single individual may participate up to twelve (12) times by tagging and sharing each of the Sponsor’s posts dated from December 14, 2023, at 6am EST until December 25, 2023, at 11:59pm PST.
Participation by any other individual or any entity, and/or originating at any other Internet web site or email address, do not qualify. The use of any device to automate the participation process is prohibited.
Selection of Recipients
Within ten (10) calendar days following the end of the Giveaway Period, from the pool of all qualifying participants the Sponsor shall randomly select twelve (12) individuals to receive an InstaFacial® Collection. The approximate retail value of each InstaFacial® Collection is $550.00 (five hundred and fifty U.S. Dollars).
Within ten (10) calendar days following the end of the Giveaway Period, from the pool of all qualifying participants the Sponsor shall randomly select one (1) participant to receive a Diamond InstaFacial®, plus $1,000 (one thousand U.S. Dollars) that the participant can use to pay for travel to Beverly Hills and lodging for one night for the prodedure. The approximate retail value of a Diamond InstaFacial® procedure is $6,500 (six thousand five hundred U.S. Dollars).
In order to receive the InstaFacial® hereunder any initially selected participant must be screened by the Sponsor’s medical and intake personnel and approved as an appropriate and medically acceptable candidate for procedure in Sponsor’s sole and absolute discretion. Not all participants that are initially selected may be approved by Sponsor as an appropriate and medically acceptable candidate for the InstaFacial® procedure. Considerations include but are not limited to the prospective patient’s health, skin tone, and any recent procedures performed on said individual.
As a condition to receiving the InstaFacial®, the participant selected shall also be required to fill out and sign (a) medical forms and liability releases and limitations as reasonably required by Diamond Laboratories, Inc. and/or its affiliated companies, and (b) photograph and likeness releases allowing the use of participant’s image and likeness in an in connection with promotions for Sponsor. In order to receive InstaFacial® procedure, the participant that is selected understands, acknowledges and agrees that the following conditions apply, including that they will be featured in photographic and video content related to Sponsor.
Subject to satisfaction of all of the foregoing requirements and conditions, the InstaFacial® procedure will be scheduled for Spring 2024.
Recipients of products and services hereunder are responsible for all taxes and fees associated with receipt and/or use. All products and services are awarded "as is" with no guarantee, either express or implied. Products and services are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. If by reason of a printing, typographical, or other error, more products and services are claimed than the number set forth in these official rules and conditions, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of products and services available. No more than the advertised number of products and services will be given.
Limit: One (1) InstaFacial® Collection per person.
Failure to comply with any provision herein may result in the participant being disqualified and an alternate participant selected. If a notification or a product or service is returned as undeliverable for any reason, the applicable product or service will be awarded to an alternate participant. Products and services are not transferable, assignable, or redeemable for cash. All decisions are final. All Federal, state and local tax liabilities are the responsibility of the recipients.
General
Participants release and waive any claims they may have against Sponsor and any of Sponsor’s affiliated persons and organizations for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney's fees) resulting from acceptance, use, or misuse of any product or service or parts thereof, or participation in this Giveaway. If for any reason, this Giveaway is not capable of running as planned, the Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend this Giveaway, or any portion thereof.
If for any reason, this Giveaway is not capable of running as planned, or if this Giveaway or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper execution of the Giveaway and processing of participation in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor's sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Giveaway, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Giveaway or any portion thereof. If such cancellation, termination, modification, or suspension occurs, notification will be posted on the Sponsor’s website. Any attempt by a participant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Giveaway is a violation of criminal and/or civil laws and should such an attempt be made. The Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
In the event a dispute arises respecting who or whether an individual qualifies to participate or satisfied the qualification requirements set forth above, the participation will be deemed submitted by the authorized account holder of the Instagram account entered, and the decision respecting qualification or disqualification, as the case may be, shall be made by Sponsor in Sponsor’s reasonable but sole and absolute discretion. The authorized account holder is deemed the natural person who is assigned to an Instagram handle by Instagram. A potential recipient may be requested to provide the Sponsor with proof that the potential recipient is the authorized account holder of the Instagram account associated with the participant and that all eligibility requirements are met.
The Sponsor and any and all Internet server(s) and access provider(s) and each of their respective affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and any of their officers, directors, shareholders, employees and agents (collectively the "Releases") are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant's or any other person's computer relating to or resulting from participation in the Giveaway; inability to access information or any website, Instagram or other account; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including any website, Instagram or other account) or for any other reason whatsoever; printing or other errors; any entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible, or any combination thereof.
Incomplete participation will be disqualified. False, fraudulent or deceptive entries or acts shall render entrants ineligible. By participating in the Giveaway, participants affirm that they have read and accepted these Official Rules and Conditions. The Giveaway shall be governed by and construed in accordance with the laws of California and the United States. All participants in the Giveaway hereby submit to the jurisdiction and venue of the federal and state courts located in Los Angeles County, California, and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum. Any entry information collected from the Giveaway shall be used only in a manner consistent with the consent given by participants at the time of the participation, these Official Rules and Conditions, and the Sponsor’s Privacy Policy (www.drdiamondsmetacine.com/pages/privacy-policy).
